Karar\u0131n temyize gitmesi sonucunda Dan\u0131\u015ftay 5. Daire mahkemesi taraf\u0131ndan karar onand\u0131.<\/p>\n<p>&nbsp;<\/p>\n<p>Karar\u0131n g\u00f6r\u00fc\u015f\u00fclmesi ile 10. \u0130dare Mahkemesi ilgili mevzuat h\u00fck\u00fcmlerini de\u011ferlendirerek patoloji doktorlar\u0131n\u0131n acilde n\u00f6bet tutamayaca\u011f\u0131na karar k\u0131ld\u0131. Acil serviste n\u00f6bet tutacak olan doktorlar \u00f6zel e\u011fitim alm\u0131\u015f sertifikal\u0131 pratisyen doktorlar\u0131n olmas\u0131 gerekti\u011fi belirtildi. Mahkeme doktorlar\u0131n uzmanl\u0131k alanlar\u0131nda g\u00f6rev alabilece\u011fini, farkl\u0131 g\u00f6revlerde i\u015f g\u00f6remeyeceklerini kabul etti.<\/p>\n<p>&nbsp;<\/p>\n<p>\u0130dari mahkemenin ald\u0131\u011f\u0131 kararda, acil sa\u011fl\u0131k hizmetinin donan\u0131ml\u0131 doktorlar taraf\u0131ndan n\u00f6bet tutabilece\u011fini onad\u0131. \u00d6zel e\u011fitim alan sertifikal\u0131 pratisyen doktorlar\u0131n bu konuda n\u00f6bet tutarak m\u00fcdahale haklar\u0131 oldu\u011funa dikkat \u00e7ekti.
